GTech's Lotto Machines to be examined by GSB


Finance Minister Korn Chatikavanij said he has ordered the Government Savings Bank (GSB) to study whether Loxley GTech Technology's machines for the aborted online lottery can be modified to sell GSB lottery tickets.
The option of modifying the machines is being looked into as a consequence of Prime Minister Abhisit Vejjajiva's last-minute decision to cancel the online two- and three-digit lottery project because of the possible social impact.

The government has to compensate the firm, and is looking for ways to offset the cost. The concession contract was signed by the Thaksin Shinawatra government in 2005.

GSB chief executive Lersak Chuladesa said the bank will have to study whether the software in the machines can be adapted to work with the GSB's computer system.

Thai Online Lottery supplier agrees not to sue government

The supplier of online lottery has agreed not to sue the government for cancelling the contract for lottery vending machine, chairman of Thai Trade Representative Kiart Sithiamorn said on Thursday.


Loxley GTech Technology (LGT) - a joint venture between Loxley Plc and US-based GTech Corporation - will cancel their planned suit against the Thai government for scrapping the online lottery project and agreed to settle the dispute between the government and the company through negotiation.

The agreement was reached Thursday in talks between Prime Minister Abhisit Vejjajiva and GTech chairman Donald R. Sweitzer and its Singapore-based vice-president for Asia Pacific, Brian Sheehan, at Government House.

The meeting, lasting about 20 minutes, was unscheduled.

Kiat Sittheeamorn, president of the Thailand Trade Representative Office, told reporters after the meeting that the GTech representatives gave a clear message that the firm has no intention to take legal action against the government.

Mr Kiat headed the panel assigned by the prime minister to study laws and contracts made with LGT to determine how to end the electronic lottery project.

The Thailand Trade Representative Office chief had earlier met the American LGT executives on January 13.

The US company said it is ready to cooperate with the government to find the best solution to be mutually agreed by both parties.

However, Mr Kiat said, while the company representatives were upset that Thailand decided to scrap the project, it is understandable as it reflects the government’s policy on social affairs.

Loxley GTech is satisfied that the goverment has committed to resolving the dispute fairly and will follow the contractual conditions, he said, adding that the firm's prospect towards Thailand would remain unchange.

No specific proposal was presented at Thurday’s talks, Mr Kiat aid, as it was too early to go into detail, especially regarding compensation.

Meanwhile, Mr Sweitzer said his trip was intended to gather information and clarity on the Thai government's policy. He affirmed that his company will comply with the government's decision.

Cancelling the project will cause the company significant damage and should be fairly compensated, he said, emphasizing that he was responsible for protecting the company's interests and remains prepared to talks with the government to arrive at an amicable solution.

Mr Sweitzer said he hoped the negotiations could be completed shortly.

Assigned by the ousted government of prime minister Thaksin Shinawatra to install electronic lottery vending machines in Thailand, Loxley GTech earlier threatened to sue the government for Bt3 billion if the Abhisit government scrapped the long-delayed project.

Under the agreement with the Government Lottery Office (GLO), Loxley is responsible for setting up the system and providing equipment, technology and services for a national online lottery in Thailand. Loxley was to receive a 75 satang fee per lottery ticket while the GLO was to own the electronic lottery.

LGT did not receive the concession from the government and the GLO-LGT contract did not come under the Public-Private Joint Venture Act, but the Office of the Council of State of Thailand had approved carrying out the online lottery under the contract.

The prime minister said earlier the project would have negative quality of life impact on society, especially on youth.

Electronic Lottery Vending Project could be scrapped

Loxley GTech Technology Co Ltd (LGT) is threatening to sue the government for billions of baht after Prime Minister Abhisit Vejjajiva revealed he would dump the online lottery.

Company CEO Trichakr Tansuphasiri yesterday said the firm would demand at least 3 billion Baht in compensation if the government cancelled the contract for the project as it had already invested about 2 billion baht in the system for online machines.

It would be difficult for foreign investors to accept if the government fails to honour the contract between the company and the Government Lottery Office (GLO), Mr Trichakr said.

The deal was signed in 2005 by the government led by then prime minister Thaksin Shinawatra and the firm, which is a joint venture between Loxley and US-based GTech Corp. GTech holds a 49% stake in the venture.

Loxley GTech Technology will charge the GLO a service fee of 75 satang for each lottery ticket, while the GLO will be the owner of the online lottery tickets.

The company has already set up the online lottery system with about 5,000 lottery vending machines.

Ticket sales were to have begun in 2006 but the scheme was abandoned by the next government led by Gen Surayud Chulanont over legal problems involving revenue sharing and strong opposition to gambling and from lottery sellers.

Mr Trichakr said several retail online lottery agents had withdrawn from the project because they were uncertain about the government's policy.

The GLO board last month decided to go ahead with the project, saying all problems had been settled.

But Mr Abhisit yesterday made clear he did not favour the project because he was concerned about encouraging young people to gamble.

The prime minister said he had kept seeking information about the lottery from the GLO after its board decided to launch the project.

Mr Abhisit's reluctance to approve the lottery led to his decision to set up a working group to look into the government's obligations.

He said the working group, led by Thai Trade Representative Kiat Sitttheeamorn, would explore ways the government could compensate the contractor. The study is expected to be ready in a month.

Mr Abhisit was confident cancellation of the project would not cause any damage to the government.

The project was initiated by Thaksin Shinawatra to curb the illegal underground lottery industry.

But Mr Abhisit said yesterday he was not convinced the illegal lottery would be wiped out as a result of the project and, in fact, it could do more harm than good to the country.

GLO board chairman Sathit Limpongpan said yesterday the board would hold an urgent meeting this week after learning of the prime minister's opposition to the project.

The prime minister "could have additional information" that the board does not have which has led to his attempt to cancel the project, he said.

Sangsidh Piriyarangsan, the director of the doctorate programme at Chandarakasem Rajabhat University and an expert on the underground economy, condemned the prime minister for trying to stop the lottery project.

He insisted the scheme could help reduce the number of people playing the underground lottery.

Without the scheme, underground lottery bookmakers and their associates would continue to enjoy making up to 30 billion baht in profit from about 300 billion baht that flows through the illegal operation each year.

Mr Sangsidh said the right way to solve the underground lottery problem was to legalise lottery schemes.

Torphong Selanon, vice chairman of the Association of the Blind, applauded the prime minister's plan to scrap the online lottery.

He said an online system would destroy the livelihoods of up to 60,000 disabled lottery ticket sellers nationwide.
